Bij een bewezenverklaring van diefstal (artikel 310 Sr) zijn de wettelijk mogelijke straffen:

Artikel 310 Hij die enig goed dat geheel of ten dele aan een ander toebehoort wegneemt, met het oogmerk om het zich wederrechtelijk toe te eigenen, wordt, als schuldig aan diefstal, gestraft met gevangenisstraf van ten hoogste vier jaren of geldboete van de vierde categorie.

De straf voor eenvoudige diefstal is dus maximaal vier jaren gevangenisstraf of een geldboete van de vierde categorie.
